Trial Results

 

  • A non-suit for an engineer in a case involving a fatal accident at a mid-block crosswalk in Philadelphia. Although the driver attempted to blame the accident on the roadway design performed by the engineer, the firm’s attorneys were able to convince the trial court that the driver failed to carry his burden of proof requiring that all claims against the engineer be dismissed with prejudice.
     
  • A defense verdict for an architect who was wrongfully blamed for structural defects in a veterinarian hospital. After a week-long trial, the jury concluded that the structural failure was a result of unauthorized contractor changes, not poor design and entered a defense verdict in favor of the firm’s client.
     
  • In a case involving a $12 million dollar building collapse, efforts to shift the blame to the engineer were rejected by the court which found that the building contractor was primarily at fault and rejected claims to recover attorney’ fees.
     
  • A defense verdict for an architectural firm in the Board of Claims in a case involving a major university renovation project in which the contractor alleged seven figure claims against the owner for extra costs and delays.  Although the owner attempted to blame the cost overruns and added expense on the firm’s client, the firm was successful in convincing the Board that the client was not responsible for the claims.
     
  • Construction site accident case involving catastrophic neck, back and head injuries. Representation of the employment agency which leased the employee allegedly responsible for the accident. Settlement with plaintiff after a five-day trial with reservation of all cross-claims amongst defendants.  Subsequent binding arbitration amongst defendants resulted in a finding of no liability on the part of the client.
     
  • Multi-million dollar fire subrogation case in which a church structure was destroyed by fire. The subrogation claim asserted that negligence on the part of the defendant oil company caused the fire. The firm’s attorneys were able to convince the jury that the clients did not cause the fire resulting in a defense verdict at trial.
     
  • Back to back verdicts at mechanics’ liens trials against developer who failed to pay for completed work based on alleged construction defects.
     
  • Defense verdict for mechanical engineer and his design/build firm in a multi-million dollar claim of professional negligence, breach of contract and breach of warranties arising from the design and construction of mechanical systems for a research laboratory building. The firm’s attorneys were able to obtain judgment on behalf of the client more than $600,000 for recovery of fees and costs associated with the defense of the claim.
