The attorneys at Brehm, Nofer & McCarter have served as appellate counsel in the state and federal courts for both Pennsylvania and New Jersey and have successfully briefed and argued appeals in the United States Court of Appeals for the Third Circuit, the intermediate Pennsylvania and New Jersey state appellate courts and the Pennsylvania Supreme Court. Our attorneys frequently work on appeals for clients who were represented in the trial court, or before an administrative agency, and simply want to have a successful outcome affirmed after an appeal has been pursued by an opponent. On other occasions, our attorneys represent clients raising appeal issues after a disappointing outcome in a lower tribunal where legal, factual, procedural, evidentiary and/or other errors may have resulted in an improper disposition of the case. Our attorneys are also frequently retained to handle appeals for clients in which other counsel were involved in the lower tribunal and do not engage in appellate practice, or the client simply wants a fresh perspective on the case.
Regardless of the process by which any matter reaches the appellate stage, the firm’s attorneys recognize that the chances of a successful outcome on behalf of the client are significantly enhanced when meticulously researched, well-reasoned and compellingly drafted briefs are filed with the court. In most cases, the filing of briefs must be followed by effective oral argument which clearly, concisely and persuasively explains why a client’s desired outcome should be reached by the court. Our attorneys have demonstrated these necessary appellate skills time and again and have achieved many favorable results for their clients.
